For a US national to obtain a US Spouse visa for his or her Thai spouse, one should have proof of legal marriage; the US national should be able to prove his or her financial capability to support his or her Thai spouse during his or her stay in Thailand and most especially financial stability in the US. The children of the US spouse visa holder are also allowed to enter the US on a dependent visa as subsidiary, either on a CR2 or IR2.

The US Spouse visa applicant should submit a petition which would be the Petition for Alien Relative (form I-130) together with the Supplemental Information for Spouse beneficiary (form I-130A). Once the I-130 application has been approved by the USCIS, these application will be forwarded to the National Visa Center and is turned over to the US Embassy in Bangkok upon approval, or whichever embassy the marriage has been registered. Once the petition for the US Spouse visa is approved, and after the screening by the US Embassy, the Thai spouse may now enter the United States and stay under the US Spouse Visa for up to two years. Within the two year period, an application for legal permanent residency should be filed by the US Spouse Visa holder.
